Terms and Conditions

These Terms and Conditions apply to all orders placed through the online shop at www.valeness.com.

Under § 13 BGB, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their self-employed professional activity. Under § 14 BGB, an entrepreneur is a person acting in the exercise of a commercial or self-employed professional activity.

Any differing terms of the person placing the order do not become part of the contract unless we expressly consent to their application in text form.

The presentation of the products in the shop does not constitute a binding offer, but an invitation to you to place an order.

The contract is concluded in the following steps:

1. You place the desired items in the basket.
2. In the basket you can see the items, the quantity and the total price, and you can change both.
3. You enter the delivery and billing address and choose the payment method.
4. On the summary page, all details are summarised once again.
5. By clicking the "Buy now" button, you place a binding order.

Correcting input errors: You can change all entries at any time until the order is submitted. In the basket, quantities can be adjusted and items removed, on the summary page you can jump back to any previous step, and the usual browser functions (back, delete, overwrite field) are available to you throughout.

Acceptance: After submitting, you will immediately receive an automatic order confirmation by email. This confirmation is at the same time the acceptance of your order: upon its receipt, the purchase contract is concluded.

Contract text: We store the contract text, i.e. the order data and these Terms and Conditions, and send it to you by email together with the order confirmation. Via a customer account, you can additionally view your orders at any time. You can access, save and print the current version of these Terms and Conditions on this page.

Contract language: The contract can be concluded in German, English, French, Italian and Spanish.

All prices stated are final prices and include statutory VAT.

Deliveries to Germany, Austria, Belgium, France, Italy and the Netherlands are free of shipping charges, with no minimum order value.

For deliveries to Denmark, Luxembourg, the Czech Republic, Poland and Spain, shipping costs are calculated according to the weight of the order and are shown at checkout before you submit your order.

Excluded from delivery are the Canary Islands, Ceuta and Melilla, the Balearic Islands, Corsica as well as Sicily and Sardinia. We do not accept orders with a delivery address in these territories; should such an order nevertheless reach us, we will cancel it and refund the full amount.

Additional charges from the carrier may apply for deliveries to islands. Should this be the case for your address, we will contact you before dispatch and agree on how to proceed: no additional costs will be incurred by you without your consent.

Deliveries outside the EU cannot be ordered through the shop. Upon request to info@valeness.com we will examine shipping on a case-by-case basis; any customs duties and import charges are borne by you in that case.

We ship from Germany, mainly with GLS.

Orders placed before 2 p.m. on a working day leave our warehouse the same day, later orders on the next working day.

After dispatch, the delivery time within Germany is usually 1 to 3 working days, to Austria usually 2 to 5 working days.

All time specifications are based on experience and are not guaranteed dates. Around public holidays and during promotional periods, delivery may take longer.

As soon as the consignment leaves our warehouse, you will receive a dispatch confirmation with a tracking number by e-mail.

Basketball stands and wall bars are bulky consignments. They are sent as a parcel, but depending on the delivery service they may arrive separately in several parcels.

Payment is processed via Shopify's payment services. Depending on the country and the contents of your basket, credit card, Apple Pay, Google Pay and Shop Pay via Shopify Payments as well as PayPal and Klarna are available. You can see which methods are actually offered to you at checkout.

The purchase price falls due for payment upon conclusion of the contract. If you choose Klarna, the payment terms agreed there and Klarna's terms additionally apply to the processing.

Purchase on account for clubs, schools, local authorities and companies is arranged in advance by e-mail to info@valeness.com. Without such an arrangement, there is no entitlement to purchase on account.

You will receive the invoice with the VAT stated by e-mail.

You may only set off claims that are undisputed or have been established as final and binding by a court. You are entitled to a right of retention to the extent that it is based on claims arising from the same contractual relationship.

The goods remain our property until payment has been made in full.

As a consumer, you have a statutory right of withdrawal of 14 days. You can find the details and the model withdrawal policy on the Withdrawal page.

You can declare your withdrawal without any particular form: by email, by post or online via the "Withdraw from contract here" button, which you will find in the footer of every page and on the withdrawal page. We will confirm receipt of your declaration without delay by email, stating the date and time.

In addition to the statutory right of withdrawal, we voluntarily grant you a return policy of 30 days from receipt of the goods. For this, the goods must be complete and in a resaleable condition. Your statutory right of withdrawal remains unaffected by this and always takes precedence over the contractual return policy.

We bear the costs of the return shipment.

The statutory rules on liability for defects apply to all goods. If the goods are defective, you may demand subsequent performance, withdraw from the contract, request a price reduction or claim damages within the statutory periods. These rights are free of charge for you.

In addition, VALENESS grants a voluntary manufacturer's warranty of 24 months from receipt of the goods against defects in materials and workmanship. The full warranty conditions are available at warranty conditions and are also sent to you in text form together with the order confirmation.

The warranty applies in addition to your statutory rights and does not restrict them.

Discount codes are valid only for the promotional period stated in each case and only once per order. They cannot be combined with other promotions, are not transferable and will not be paid out in cash.

The 10 % newsletter discount applies to the first-time newsletter sign-up, once per person, and is sent by email after the sign-up has been confirmed.

If an order is withdrawn in whole or in part, we will refund the amount actually paid; any discount granted will lapse proportionately.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

The European Commission's platform for online dispute resolution was discontinued as of 20 July 2025. A reference to it is therefore no longer included.

The contract languages are German, English, French, Italian and Spanish.

The versions of these conditions in languages other than German are translations provided for ease of understanding. The German version is authoritative; in the event of discrepancies, the German text prevails.

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you, as a consumer, have your habitual residence in another member state of the European Union, the mandatory consumer protection provisions of that state remain unaffected.
